Use of Multi-Occupancy Private Spaces

  1. Oversight and Responsibility
    Implementation of the Administrative Rule and this Guideline/Procedure is overseen by the following offices:
    • Office of the Chancellor
    • Office of the Executive Vice Chancellor of Finance and Administration
    • Office of Equal Opportunity Compliance
    • Office of Community and Government Affairs
    • College Legal Counsel
    • Office of Human Resources Office of Campus Planning, Construction & Sustainability
      These offices will coordinate communication, training, and compliance monitoring and ensure that facility designations and access meet state and federal requirements.
  2. Prohibited Conduct
    1. Entering a multi-occupancy restroom, locker room, or changing facility designated for a biological sex other than one’s own unless an exception as set out in the Administrative Rule applies.
    2. Harassing or intimidating any individual regarding perceived violations of this Administrative Rule.
  3. Reporting Violations
    Reports of violations or concerns may be submitted through the Student Conduct process or the Office of Equal Opportunity Compliance the Office or the Office of Human Resources for employees and campus visitors.
  4. Enforcement
    Violations will be addressed in accordance with existing Administrative Rules, the Student Code of Conduct, or Employee policies. 
  5. Protection from Retaliation
    No individual shall face retaliation for submitting a report in good faith or requesting clarification or accommodation under this rule.
  6. Safety, Privacy, and Education
    1. The College affirms that all individuals have the right to privacy and safety while using ACC facilities.
    2. As appropriate, ACC shall provide education and awareness training to employees and students regarding this Administrative Rule and applicable laws.
    3. Training shall be coordinated by the Office of Human Resources and the Office of Equal Opportunity Compliance and include information from the Office of Community and Government Affairs on legislative updates.
  7. Definitions
    1. Multiple Occupancy Private Space:
      A facility designed for use by more than one person at a time where individuals may be in a state of undress, including restrooms, locker rooms, and changing areas.
    2. Single occupancy private space:
      A facility designed or designated for use by only one individual at a time and in which the individual may be in the state of undress. For example, a single toilet restroom that has walls that extend from floor to ceiling and a locking door, and that is designed or designated as unisex;
    3. Visitor:
      Any person present on ACC property who is not an enrolled student or employee.
    4. Violation:
      Conduct inconsistent with this rule, including misuse of facilities or harassment of others regarding facility use.
